Will of Simeon Cook

I, Simeon Cook, a resident of Shelby County, Kentucky, declare the following to be my last will, hereby revoking all wills heretofore made by me:

First. I appoint the Peoples Bank and Trust Company, of Shelbyville, Kentucky, executor of this will, and as trustee for the purposes hereinafter set out; and I direct said executor to pay my debts and funeral expenses as soon after my death as practiable.

Second. I bequeath to my sister, Ella Hulette, the sum of one hundred dollars.

Third. I bequeath and devise to said trustee what may remain of my personal and real estate after the payment of my debts, funeral expenses, the above bequest to my sister and the costs of the administration of my estate, the same to be held by said trustee in trust for the following uses and purposes:

Said trustee is directed to invest what may remain of my personal estate in good and safe securities, and to rent and lease my real estate, and to pay the entire net income from such personal and real estate, semiannually, and in equal shares, to Lillian Cook, the widow, and Curtis Simeon Cook, the son, of George Curtis Cook, deceased, whom I reared from infancy, and whom I regarded and loved as a son, until said Curtis Simeon Cook arrives at said age, then the whole of such income shall be paid to him; and if he should die before he reaches said age, the whole of such income shall be paid to the said Lillian Cook so long as she shall live, and whether she shall remain a widow, or shall remarry.

Fourth. Upon the arrival of the said Curtis Simeon Cook at the age of thirty years, the trust herein created shall cease, and my entire estate, both personal and real, then in the hands of said trustee, shall be turned over and delivered by it to the said Curtis Simeon Cook, and shall become his property, absolutely and in fee simple; but, if the said Curtis Simeon Cook should die before reaching said age, leaving issue surviving him, then such estate shall become the property of such issue, subject to the right of the said Lillian Cook to the income there from during her life.

If the said Curtis Simeon Cook should die before he arrives at the age of thirty years, without surviving issue, then my entire estate in the hands of the said trustee shall become the property of my next of kin who would have inherited the same, if I had died intestate, subject the right of the said Lillian Cook to the income there from during her life.

Fifth. I appoint the said Lillian Cook as the guardian of the said Curtis Simeon Cook hereunder, and I direct that no surety shall be required on her bond as such guardian.

The foregoing instrument was this day, in our presence, signed and acknowledged by Simeon Cook as his last will; and we, in his presence and in the presence of each other, signed said instrument as witnesses thereto.

Order Shelby County Court, April term, May 1st, 1924

An instrument of writing purporting to be the last will and testament of Simeon Cook deceased who died and a resident of Shelby County, was this day produced in open Court, and offered for probate. The due execution of said instrument being proven by the oaths of C. G. Barrickman and O. T. Kaltenbacher the two subscribing witnesses thereto, whereupon said instrument is duly admitted to probate and ordered recorded as and for the last will and testament of Simeon Cook deceased.
